  1. Deposit & Security Deposit:

A $1000 deposit is required to guarantee dates, no interest will be paid on the security/damage deposit. Once contract cancellation date has passed, the deposit will roll over to become a refundable damage deposit to protect owners from any damages to the premises or other charges as agreed in sections 8-17 below. Damages and other charges listed will be deducted from the damage deposit.

  1. Spa/Swimming Rules:

Underage children and children without adult supervision should not use spa or swimming pool at any time. Remember, there are certain health risks associated with spa use. Pool and Spa use is at your own risk. Spa heating is complimentary based on normal usage (up to a 3 hours per day). Spa should not be heated continually. If it is determined the Spa was used excessively, as determined by pool temperature, the prevailing pool heating fee may be deducted from the damage deposit.

  1. Pool Heating:

Swimming Pool heating is $125.00/day which is an actual cost to owners. The pool will be heated to 83F degrees which is an ideal swimming temperature. I acknowledge and agree I will not change the heater temperature without prior authorization or I may forfeit my damage deposit. Pool heating for the above rental period is $ If heating is elected, the amount should be included with the rental payment. Pool heating must be elected no less than 5 days in advance of check-in and must be paid for in advance. Pool heating is not generally required during summer months.

If broken glass or food is found in the swimming pool/Jacuzzi and determined to be from your rental, entire Security Deposit will be forfeited to drain, clean and refill pool. Plastic cups are provided for outdoor use.

Cancellation Date: 90 days in advance of check-in

We strongly urge our renter’s to purchase trip Insurance for their own protection.

  1. Inclement Weather:

______I Acknowledge that no refunds will be provided for storms, wind, rain, snow or other inclement weather, widespread power outages or “acts of god” unless local authorities enforce a mandatory evacuation. In this case, all unused rents following the mandatory evacuation date will be refunded.

  1. Utilities:

All utilities, except pool heating indicated in section 8, will be paid by owners. Monthly rentals may require a separate utility agreement.

  1. Check-In and Check-Out Times:

` Check-In is no earlier than 4:00 pm on the day of your scheduled arrival. If you arrive at the property earlier than check-in time without prior arrangements, you will be charged an early check-in fee of $175.00.

Check-Out time is no later than 11:00 am on the day your scheduled departure. If you do not vacate the premises on time without prior arrangements, you will be charged a late check-out fee of $75 or one additional night’s stay.

Early Check-In (11:00 am) and/or Late Check-Out (4:00 pm) may be available depending on home’s rental status. If early Check-In and/or Late Check-Out are requested, notify owners in advance. If available, a $175.00 early check-in fee and/or $175.00 late check-out fee will be charged. Early Check-In and Late Check-Out are not guaranteed. Owners will reimburse renter’s any fees paid if we cannot accommodate the Early Check-In/Late Check-Out.

**Owners reserve the right to cancel early check-in/late check-out, if elected, prior to arrival if it interferes with another booking. In the event this situation occurs, the early check-in/late check-out fee will be refunded to renters.

  1. Checkout Procedure:

See Addendum 1 attached to this rental contract for check-out requirements. Failure to perform the check-out procedure as listed in Addendum 1 may result in deductions from or forfeiture of damage deposit. Failure to return all keys (if applicable) will result in a re-keying fee of $75.00, which will be deducted from the damage deposit. We are not responsible for any personal items left behind, lost or stolen.

  1. Parties/Unauthorized guests/Events are not allowed on the premises without prior written consent of the owners. Failure to comply with this rule will result in forfeiture of entire security deposit and immediate eviction from the property with no refund given.

  1. City of Palm Springs Noise Ordinance Clause:

______ I acknowledge that as the signer of this contract, I am the responsible party for enforcing the strict noise ordinances imposed by The City of Palm Springs on vacation rentals with the rest of my group. A representative of Palm Springs Cool Rentals must contact you within 30 minutes of a noise complaint and a member of your party must be available to answer the call or text and immediately cease any excessive noise. If this procedure is not complied with, the police will be dispatched to the home. Failure to comply with the noise complaint ordinance may result in minimum $1000 fine to “renters” by the City of Palm Springs as well as a potential forfeiture of the damage deposit and immediate eviction from the property with no refund given. Music is not allowed outside at any time and pool noise should be kept at a reasonable level, particularly at night and in the morning. Primary renter is responsible for informing all occupants of these rules and ensuring compliance.

  1. Good Neighbor Brochure Acknowledgement:

______I acknowledge that I have been provided a copy of the “Good Neighbor Brochure for Vacation Rentals” and will follow the City of Palm Springs rules.

_______I acknowledge that renter and all guests will be required to sign an acknowledgement of rules upon check-in or a predetermined time as required by the City of Palm Springs.

  1. Municipal Code Legally Responsible Party:

______I acknowledge that as the responsible signee to this contract, I am legally responsible for the compliance of all occupants and guests of the vacation rental home with all applicable laws, rules and regulations pertaining to the use and occupancy of the short term rental.

  1. No Commercial Use:

______I acknowledge that as the responsible signee to this contract, I will not use the premises for any commercial or unlawful purpose including, but not limited to, using, manufacturing, selling, storing or transporting illicit drugs or other contraband, violate any law or ordinance.

  1. Condition of Premises:

______ I acknowledge occupant has not viewed the premises prior to entering into this agreement. Occupant shall, on arrival, examine the premise, all furniture, furnishings, appliances, fixtures and landscaping, if any, and shall immediately report in writing if any are not in operating condition or are in disrepair. Reporting repairs does not give occupant the right to cancel this agreement or receive a refund of any payments made,, unless repairs needed prevent the occupants use and enjoyment of premises.

  1. Entry:

______ I acknowledge owner and owners’ representatives and agents have the right to enter the premises, at any time (with notice); (i) for the purpose of making necessary or agreed repairs, decorations, alterations, improvements, for maintenance or to supply necessary or agreed upon services; (ii) to verify the occupant has complied with the terms of this agreement (iii) in case of emergency.

  1. Maintenance:

_____I acknowledge I will properly use, operate and safeguard the premises including, if applicable, any landscaping, furniture, furnishings, appliances and all mechanical, electrical, gas and plumbing fixtures, and keep them clean and sanitary. Occupant shall immediately notify owner or owner’s representative of any problem, malfunction or damage. Occupant shall pay for all repairs or replacements caused by Occupant, guest and licensees of occupant excluding ordinary wear and tear. Occupant shall pay for all damage to the premises as a result of failure to report a problem, malfunction or damage in a timely manner.

  1. Alterations:

_____I acknowledge occupants will not make any alterations in or about the premises including, but not limited to, moving furniture, painting, wallpapering, adding or changing locks, installing antenna or satellite dishes, placing signs, displays or exhibits or using screws, fastening devices, large nails or adhesive materials.

  1. Surveillance Cameras in Use:

______I acknowledge that owners operate video surveillance cameras on exterior of property pointed towards the front door, the backyard gate and backyard exterior wall that are active with video and photo capture. These cameras on not pointed towards any guest used spaces.

Disconnecting these cameras will result in immediate eviction from the premises with no refunds given.

  1. No Assignment or subletting:

______ I acknowledge that this agreement is between owner and signed occupant. The agreement is not assignable to any other person without approval from owners. I acknowledge that owners will not honor an assigned agreement without prior approval. The occupant may in no way sublet this property or allow guests who are not listed in the contract. If renter is found in violation of this clause the occupants will be asked to leave the premises immediately and renter forfeits their entire damage deposit with no refunds given.

  1. Unavailability:

______ I acknowledge that if for any reason beyond the control of owner or owner’s representative, the premises is unavailable, owner may substitute a comparable unit or cancel the agreement and refund in full to occupant all payments made.

  1. Mediation:

______ I acknowledge to mediate any dispute or claim arising out of this agreement, or any resulting transaction, before resorting to arbitration or court action. Mediation fees, if any, shall be divided equally among the parties involved.

  1. Joint and Individual Obligations:

______ I acknowledge if there is more than one occupant, each one shall be individually and completely responsible for the performance of all obligations under this Agreement, jointly and individually with every other occupant.

  1. Personal Property and Injury:

______I acknowledge the following

  1. Owner Insurance: Occupant’s or guests’ personal property, including vehicles, are not insured by Owner against loss or damage due to fire, theft, vandalism, rain water, criminal or negligent acts of others, or any other cause,. Owner does not insure against personal injury to Occupant, guests or licensees due to any reason other than the condition of the premises.
  1. Occupant Insurance: Owner recommends that occupant carry or obtain insurance to protect occupant, guests and licensees and their personal property from any loss or damage.
  1. Indemnity and Hold Harmless. Occupant agrees to indemnify, defend and hold harmless owner and Owner’s representatives from all claims, disputes, litigation, judgments, costs and attorney fees resulting from loss, damage or injury to occupant, occupant’s guests or licensees or their personal property.
  1. Pool Liability Waiver:

_____ Owners shall not be liable to renter, renter’s guests, licensees or invitees or any other person for any injury, loss or damage to any person or property, including theft, on or about the premises. Renter shall hold owner and managers harmless and indemnified from and against all loss, injury or damage occasioned by the use or misuse or abuse of any part of the premises including the approximately 5 ½ foot deep swimming pool and spa. Keep children away from pool and spa unless there is constant adult supervision. Renter agrees not to hold owners liable or responsible for any injuries, accidents or any other damages as a result of pool or spa use and from or against any omission, neglect or default of renter, renter’s guests, licensees or invitees.

  1. Acceptance of Rental Agreement:

From my signature below, I acknowledge that I have read and understand the rules and regulations. I certify that I am the primary renter and that I will be held responsible for the care of this property being rented under my name. I accept full responsibility for damages or extra cleaning charges, should they be discovered during or after departure.

Check out Procedure

WE HOPE YOU HAVE ENJOYED YOUR STAY

In an effort to keep the cleaning fee to a minimum, we require our guests to perform the following actions prior to check-out. Failure to do any of the following will result in a deduction from your security deposit.

  • Dispose of all food items and recycling in OUTSIDE trash cans
  • Turn Off: Pool Heater/Jacuzzi if required

  • Cover outdoor grill
  • Return all furniture if moved to its original location
  • Turn OFF: Stereo, Televisions, DVD Player, Lights and Appliances
  • Turn thermostat A/C/Heat to OFF position
  • Lock All Doors and Windows
  • Check Safe and house for any left items such as plugs and chargers

  1. This home is on a septic system. Food waste must be disposed of in trash can and care must be given in items that are flushed down the toilets. Only toilet tissue may be flushed down toilets. NO other items including feminine products may be flushed down toilets.

  1. High Wildfire Risk Area Acknowledgment:

______I acknowledge that the property is located in a high-risk for wildfire area and that I will need to monitor local weather and news to be aware of any potential wildfire activity. I may receive an alert and be required to evacuate at a moment’s notice. Owners are not responsible for any potential damage or liability from a wildfire circumstance. Further, I will not engage in any dangerous activities while occupying the residence that could cause a wildfire such as cigarettes, lit matches, candles, open flames. Open flames must be contained to the enclosed fireplace and enclosed grill. Propane fire pit use is acceptable only on the front deck. Evacuation procedures for Idyllwild-Pine Cove can be reviewed at Idyllwildfire.com and Rivcoready.org.

  1. Wilderness and Potential Dangerous Wildlife Acknowledgement:

______I acknowledge that the property is located in a wilderness environment and that I may come into contact with potentially dangerous animals on the property. These animals include but are not limited to (bears, mountain lions, bobcats, deer, raccoons, foxes, coyotes, mice, rats, squirrels, bats, various snakes including rattle snakes, spiders and scorpions). Please exercise appropriate caution when venturing into the wilderness environment.

Occupant shall, on arrival, examine the premise, all furniture, furnishings, appliances, fixtures and landscaping, if any, and shall immediately report in writing if any are not in operating condition or are in disrepair. Reporting repairs does not give occupant the right to cancel this agreement or receive a refund of any payments made, unless repairs needed prevent the occupants use and enjoyment of premises.

  1. Entry:

______ I acknowledge owner and owners’ representatives and agents have the right to enter the premises, at any time (with notice); (i) for the purpose of making necessary or agreed repairs, decorations, alterations, improvements, for maintenance or to supply necessary or agreed upon services; (ii) to verify the occupant has complied with the terms of this agreement (iii) in case of emergency.

  1. Maintenance:

_____I acknowledge I will properly use, operate and safeguard the premises including, if applicable, any landscaping, furniture, furnishings, appliances and all mechanical, electrical, gas and plumbing fixtures, and keep them clean and sanitary. Occupant shall immediately notify owner or owner’s representative of any problem, malfunction or damage. Occupant shall pay for all repairs or replacements caused by occupant, guest and licensees of occupant excluding ordinary wear and tear. Occupant shall pay for all damage to the premises as a result of failure to report a problem, malfunction or damage in a timely manner.

  1. Alterations:

_____I acknowledge occupants will not make any alterations in or about the premises including, but not limited to, moving furniture, painting, wallpapering, adding or changing locks, installing antenna or satellite dishes, placing signs, displays or exhibits or using screws, fastening devices, large nails or adhesive materials.

  1. Exterior Surveillance Cameras and Noise Monitors in Use:

______I acknowledge that owners operate video surveillance cameras on exterior of property pointed towards the front door, and backyard exterior wall that are active with video and photo capture. These cameras are not pointed towards any guest used spaces.

______I acknowledge that owners operate a noise a monitoring device on the exterior of property to alert owners of exceeded noise decibel levels as required by the County of Riverside

Disconnecting these cameras or noise monitoring devices will result in immediate eviction from the premises with no refunds given.

  1. No Assignment or subletting:

______ I acknowledge that this agreement is between owner and signed occupant. The agreement is not assignable to any other person without approval from owners. I acknowledge that owners will not honor an assigned agreement without prior approval. The occupant may in no way sublet this property or allow guests who are not listed in the contract. If renter is found in violation of this clause the occupants will be evicted immediately and renter forfeits their entire damage deposit with no refunds provided.

  1. Unavailability:

______ I acknowledge that if for any reason beyond the control of owner or owner’s representative, the premises is unavailable, owner may substitute a comparable unit or cancel the agreement and refund in full to occupant all payments made.

  1. Mediation:

______ I acknowledge to mediate any dispute or claim arising out of this agreement, or any resulting transaction, before resorting to arbitration or court action. Mediation fees, if any, shall be divided equally among the parties involved.

  1. Joint and Individual Obligations:

______ I acknowledge if there is more than one occupant, each occupant shall be individually and completely responsible for the performance of all obligations under this Agreement, jointly and individually with every other occupant.

  1. Personal Property and Injury:

______I acknowledge the following

  1. Owner Insurance: Occupant’s or guests’ personal property, including vehicles, are not insured by Owner against loss or damage due to fire, theft, vandalism, rain water, criminal or negligent acts of others, or any other cause,. Owner does not insure against personal injury to Occupant, guests or licensees due to any reason other than the condition of the premises.
  1. Occupant Insurance: Owner recommends that occupant carry or obtain insurance to protect occupant, guests and licensees and their personal property from any loss or damage.
  1. Indemnity and Hold Harmless. Occupant agrees to indemnify, defend and hold harmless owner and Owner’s representatives from all claims, disputes, litigation, judgments, costs and attorney fees resulting from loss, damage or injury to occupant, occupant’s guests or licensees or their personal property.
  1. Acceptance of Rental Agreement:

From my signature below, I acknowledge that I have read and understand the rules and regulations. I certify that I am the primary renter and that I will be held responsible for the care of this property being rented under my name. I accept full responsibility for damages or extra cleaning charges, should they be discovered during or after departure.

Check out Procedure

WE HOPE YOU HAVE ENJOYED YOUR STAY

In an effort to keep the cleaning fee to a minimum, we require our guests to perform the following actions prior to check-out. Failure to do any of the following will result in a deduction from your security deposit.

  • Throw away all perishables from the refrigerator
  • Dispose of all food items
  • Place trash in outdoor trash can
  • Take recycling with you if possible
  • Leave all dishes clean
  • Place all outdoor cushions back where you found them. Take down patio umbrella and anything you used on clearing games/umbrella.
  • Cover outdoor grill
  • Return all magazines, books and furniture to where you found them
  • Turn OFF: Stereo, Television, DVD Player
  • Turn OFF: Wall heaters, Fans, Evaporative Cooler
  • Turn OFF all Lights and Appliances
  • Lock All Doors and Windows
